Gilbert v. Provost, 2015 QCCS 4741 — Civil Liability (Personal Injury / Dog Attack)

Me Loiselle represented Mr. Gilbert in a civil liability action (personal injury). Mr. Gilbert lost the use of one eye after being scratched by a dog belonging to his ex-partner. As he was not considered the keeper or user of the animal, the presumption of owner liability applied. The defendant failed to prove any fault on the part of the victim or any provocation. The Court ordered the defendant to pay $100,000 in damages, plus interest and legal costs.

Dugré v. Relais de santé de L'Ours polaire inc., 2018 QCCQ 903 — Civil Liability (Slip and Fall at Spa)

Me Loiselle represented Ms. Dugré in a civil liability action following a fall in a spa that caused an ankle fracture. The Court concluded that the spa failed in its safety obligation (absence of mats or anti-slip strips), but that the victim also committed contributory fault (worn sandals, failure to use the railing). Liability was therefore shared at 50% each.
